There’s a case in the Michigan courts right now attempting to overturn the state’s ban on same-sex marriage on the grounds that it’s unconstitutional, as the Supreme Court ruled last week in ditching the Defense of Marriage Act or DOMA. My read is that this same strategy will be used elsewhere and that’s it’s only a matter of time, even if it takes another decade, before gay marriage will be legal in all 50 states – whether a state wants it or not.
I mean, did the feds ask Mississippi whether it wanted to desegregate?
